Liability Release and Express Assumption of Risk

RELEASE AND EXPRESS ASSUMPTION OF RISK AGREEMENT In consideration for being permitted to register for, attend, participate in, or compete in a G-Ratt Tournament (the “Event”), I acknowledge and agree as follows:

1. RELEASE AND WAIVER OF LIABILITY: To the fullest extent permitted by California law, I, on behalf of myself and my heirs, executors, administrators, personal representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue G-Ratt Baits, its affiliated entities, event organizers, sponsors, officers, directors, employees, agents, representatives, contractors, volunteers, successors, and assigns (collectively, the “Released Parties”) from claims for personal injury, death, or property damage arising out of or relating to my participation in the Event, including claims resulting from the ordinary negligence of a Released Party. This Release does not apply to gross negligence, reckless or intentional misconduct, fraud, willful injury, or any other liability that cannot lawfully be released or waived under California law.

2. INDEMNIFICATION: To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims arising from my own negligent, reckless, or intentional acts or omissions in connection with the Event. This provision does not require me to indemnify any Released Party for that Released Party’s gross negligence, reckless or intentional misconduct, or other liability that cannot lawfully be shifted by agreement.

3. ASSUMPTION OF RISK: I acknowledge that participation in the Event involves inherent and other risks, including, without limitation, accidental injury or death; drowning; slips, trips and falls; boating and watercraft accidents; collisions; changing water and weather conditions; remote locations; wildlife encounters; fishing hooks, lines, lures and other fishing equipment; firearms and ammunition in hunting events; accidental or misdirected gunfire; actions of other participants; defective or malfunctioning equipment; transportation; terrain; heat; cold; dehydration; and other risks inherent in outdoor recreational activities. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, including risks arising from the ordinary negligence of a Released Party or others, and assume full responsibility for my participation in the Event, to the fullest extent permitted by California law.

4. PHYSICAL CONDITION AND ABILITY TO PARTICIPATE: I understand that participation may involve strenuous physical activity. I am responsible for determining whether I am physically capable of safely participating in the Event and for obtaining medical advice before participating if appropriate. I agree not to participate in any activity that I reasonably believe exceeds my physical abilities, experience, training, or condition.

5. PUBLICITY AND MEDIA RELEASE: I authorize G-Ratt Baits and its authorized assignees to photograph, record, and use my name, voice, likeness, image, biographical information, and statements captured in connection with the Event for editorial, promotional, advertising, and other lawful purposes, without compensation, to the extent permitted by law.

6. GOVERNING LAW; SEVERABILITY: This Agreement shall be governed by and construed under the laws of the State of California. If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect. BY PARTICIPATING IN THE EVENT, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ, UNDERSTAND, AND AGREE TO ALL CONDITIONS AND TERMS SET FORTH IN THIS AGREEMENT. I UNDERSTAND THAT THIS IS A LEGALLY BINDING CONTRACT AND THAT I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE RELEASED PARTIES FOR THEIR ORDINARY NEGLIGENCE. I intend this Agreement to provide the Released Parties with the broadest release of liability for ordinary negligence permitted under California law, but I do not release any claim that California law prohibits from being released.
